An Indiana woman released from prison after 16 years in August will not face a new trial in the death of her 3-year-old son after arson and murder charges were dropped Tuesday in Greensburg, Ind.

The decision by prosecutors is a victory for Kristine Bunch, 39, and her legal team as well as for the push among some experts to rectify convictions based on unreliable and outdated fire science.

In 1996, a jury convicted Bunch of murder and arson, with prosecutors relying on fire science that had already begun to change. Investigators cited burn patterns as evidence of an accelerant, a material that quickens the spread of a fire.

If related false convictions are addressed one-by-one, thousands of innocents – likely tens of thousands – will die behind bars.

Arson convictions that were based on outdated fire forensics ought to be granted automatic retrials, regardless of any confessions, regardless of any eyewitness testimony, regardless of any factor well-known to innocence advocates to be routinely unreliable.

The same holds true for those convicted on the testimony of discredited dog handlers like John Preston and Keith Pikett, or the FBI’s too-unreliable dog handlers. The same holds true for those convicted with the FBI’s junk science Comparative Bullet Lead Analysis, as well as their hair and fiber analysis. The same hold true for the those convicted on the testimony of discredited medical examiner Steven Hayne.

Mike Ledford never needed me to test and report in August that a thrown candle self-extinguished, as did a dropped candle. A leading fire forensics expert had already cleared Mike; he should have been home for every holiday since the report was written.
