During Wednesday’s court hearing an attorney for the state admitted [Dale] Johnston was innocent, but argued Ohio law prevents Johnston from coming to court a second time to prove he was wrongfully imprisoned.
“Do we want to bend or break legal rules over a set of facts?” asked Deputy State Solicitor Stephen Carney, “the answer is no.”
Stephen Carney is opposed to rulings based on facts.
So much so that he actually wants a man who spent five wrongful years on Ohio’s death row to die with his name still sullied.
This illustrates all my prior arguments about the American Bar Association’s criminal negligence as the SCOTUS-assigned governing authority over public attorneys.
Bust the ABA, IRS Oversight Board.
